Engagement: Analysis of an Operating Agreement at John Smith Road Landfill
Description of Services: IntelliWaste, Inc. was retained in November 2010 to assist San Benito County regarding an analysis of an Operating Agreement at John Smith Road Landfill with the current operator. On September 14, 2010, the County directed the revision of the current Operating Agreement including material changes in the scope of services to be provided by the provider, as well as significant revisions in Landfill ownership liability and responsibility of the County. Subsequently, IntelliWaste engaged by the County to provide an independent, third-party, expert review and opinion of the merits of the Agreement between the parties. Specifically, IntelliWaste’s scope of work and goal was to determine whether this is a “good deal” for the County on a long-term basis, both from a financial and operational perspective. To analyze and test the “good deal” assumption, we developed both qualitative and quantitative approaches to the available data and information which allowed us to opine on the issues and prepare findings and recommendations for the San Benito Board of Supervisors’ (Board) consideration. Our report and findings formed the basis of an approved new operating Agreement. The engagement was successfully conducted under very aggressive scheduling and time constraints to the satisfaction of all parties involved. We are currently assisting San Benito County through its membership with the Central Coast Recycling Market Development Zone (CCRMDZ) in a survey of recycled feedstock usage within the four Counties that made up the CCRMDZ.
